Terms of Sale:
By placing an order through latierraagave.com, you accept these terms and conditions.
Shipping:
Once you have ordered a product online, we will try our best to get the product to you as soon as possible. We have a third-party courier delivering nationwide, therefore orders will be delivered within 3-7 working days. The shipping times we provide are estimates only. We will not be held accountable for late deliveries or loss or damage relating to these late deliveries. In the event that multiple items are ordered, part deliveries may be made where stock is not available. All reasonable attempts to notify you will be made using the details you provided.
Postage & Handling:
All orders placed on our website will be charged a delivery fee of R100. We will make every attempt for orders placed before midnight on each working day to be dispatched to the courier within the next 2 business days – i.e., within 24-48 hours – or faster.
Orders placed on the weekends will be handled along with all orders placed until midnight of the day before the next working day, and as above delivered within 3-7 working days.
We do not currently fulfil international orders at this time.
Change of Address:
We cannot be held responsible for an incorrect address being entered on your order. Address confirmation is given in the checkout section of the site. If this is not noticed until after your order is finalised, please contact us immediately. We will attempt to update any incorrect order details, however due to the fast turnaround of our shipping, some orders cannot be adjusted. La Tierra Agave cannot be held responsible for incorrectly entered shipping addresses and will not replace orders not delivered as a result of you entering an incorrect address.
Order Acceptance Policy:
Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. A contract for the purchase of the goods will not be formed until your order has been approved, your payment has been approved and we have debited your credit or debit card.
We reserve the right at any time after receipt of your order to accept or decline your order for any reason. We reserve the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item. All orders placed must obtain pre-approval with an acceptable method of payment, as established by our credit department.
We may require additional verifications or information before accepting any order. Upon cancellation of an order, we will make all reasonable attempts to contact you using the details provided. All received monies will be refunded using the method received.
Acceptance of the Goods:
The buyer is responsible for inspecting the goods for fault and notifying us within the same working day of receiving the goods should there be a fault.
Typographical Errors:
In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information, we shall have the right to refuse or cancel any orders placed for the product listed at the incorrect price.
We shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, we shall immediately issue a credit to your credit card account in the amount of the charge.
Warranties:
All warranties, if applicable, are that of La Tierra Agave. All express or implied guarantees, warranties, representations or other terms and conditions not contained in these terms and conditions, are excluded from these terms and conditions and your contract with us to the maximum extent permitted by law. To the fullest extent permitted by law, our liability for any warranty or condition implied at law is limited to the replacement of the goods or the supply of equivalent goods.
Refunds & Returns:
All Agave Spirits processed and dispatched are non-refundable, unless otherwise agreed to with La Tierra Agave. In the event you are unsatisfied with your purchase please contact us as soon as possible to discuss your concern. We will happily offer you a credit note, or exchange, should your product not meet our high-quality standards. Each situation will be handled on a case-by-case basis, depending on your concern, and whether or not we will require the product to be exchanged or a new delivery dispatched. Full refunds will only be granted under specific, extenuating conditions. Please contact us directly to discuss your concerns.
Returns of merchandise must be in as new condition with tags attached unless faulty. We recommend sending returns via registered post as we do not accept responsibility for lost items. We will happily exchange non sale items provided the item and its packaging are in its original condition with the original tags attached. See below for the time frame your exchange or refund must be made in:
Exchanges (full price items) – 30 days from date of purchase
Exchanges (sale items) – final sale
Refunds (full price items) – 30 days from date of purchase
Refunds will not be made outside these time frames.
Order Cancellations:
If notified before goods have been dispatched, we can accommodate order cancellations under specific conditions, including the acknowledgement of receipt of the cancellation by La Tierra Agave prior to dispatch. If we are able to honour the order cancellation, we will issue a credit note for the full amount of the order cancelled, valid for 6 months’ time. We reserve the right to charge a cancellation fee of R200 should the above conditions not be met in full.
